Caribbean Spaces and Assertions of Asymmetric Power: A Critical Review of Property Rights and Investment Protection Clauses in Bilateral International Agreements (BITs) in British Caribbean States | Book Publisher International

 Property Rights and Investment Protection Clauses in British Caribbean Bilateral International Agreements (BITs) were the subject of this work. The goal of this study is to add to the growing body of knowledge about bilateral investment treaties (BITs), which, despite being a relatively new legal phenomena in international law, have grown in popularity as globalisation has increased. The international arbitration mechanism, which allows for direct interaction between host states and foreign investors and serves as an international dispute settlement body that carves out legal sovereignty from host states in order to ensure legal protection of foreign investors, is an important component of the BIT ecosystem that helps to improve property rights enforcement. Finally, the potential of the BIT regime to evolve, embrace change, and endeavour to minimise the efficacy of power imbalance has challenged original views of BITs as vehicles of the neocolonialist, neo-imperialist agenda for Caribbean host governments.
